What is the Freedom of Information Act (FOIA)?
The Illinois Freedom of Information Act (FOIA) law was enacted on July 1, 1984. It is intended to provide citizens access to all official documents and records in whatever form they are maintained. Additional information regarding FOIA is found at the Illinois Attorney General Website.
What documents do not require a formal request?
Any documents available to view through the Village website do not require a request and can be viewed by anyone at any time.
Is there a fee?
There is no charge to email responses. The Village will supply up to fifty (50) black-and-white pages of requested records NOT intended for a commercial use at no charge to the requester. Fees for additional copying or certification fees are as follows: black & white copies (letter or legal) - $0.15¢ per page; oversize or color copies – cost of reproduction; Certified copies - $1.00 per document. If applicable, copies of public records will be provided only upon payment of the required fees. Certain records are exempt from inspection; if a document is exempt, you will be notified. A photo ID may be required to obtain some documents.
How long will it take to get a response?
The Village, by law, will respond no later than five business days after receipt of a non-commercial request. Commercial requests will receive a response no later than 21 business days after receipt. (Requests are commercial if the use of any part of the record or the information derived from the record is to be used for sale, resale, solicitation, or advertisement for sales or services.) However, the Village may extend the time to respond within the time period allowed by law in certain circumstances. In all cases, the Village will respond as soon as possible after the receipt of the request.
What information is not available?
Certain information is exempt from release, including but not limited to personal information, medical records, trade secrets, information regarding a minor, preliminary drafts and notes, and copyrighted documents such as architects plans.
